Making a purchase could not be easier -­‐ just browse our online store, click on any items that you wish to buy /book and put them into the shopping basket. After you have finished your selection, click on “Add to Basket” and you will be asked for a few simple details that we need to be able to satisfy your purchase. All of our transactions and postage costs are in British Pounds and apply to UK customers.

back orders

If your item is not currently in stock, we will contact you immediately to advise you on how long you are likely to have to wait for it to be available. You will always be emailed with the option to cancel your order.

tax charges

VAT or local purchase tax is not included. For customers outside the UK, wishing to make a purchase, please e-­‐mail us at info@pearcemayfield.com and we will be happy to deal with your enquiry.

credit card security

Digital signatures are used throughout the system in order to ensure that transactions arriving at a gateway are from an identifiable merchant, and that any information passed back to the merchant is from a SAGEPAY gateway. Each signature uniquely identifies its source. Gateways also communicate with each other and with the control system using such digital signatures. In the event that a merchant’s digital signature becomes a security risk (e.g. if their server is stolen), the appropriate signature will be immediately revoked and will no longer function within the system. SAGEPAY is the official Certification Authority (root CA) for these signatures.

encryption

All communications within the system are strongly encrypted using 2048-­‐bit RSA encryption with variable 168-­‐bit session keys (i.e. each transaction uses a new key). This is significantly (many billions of times) more secure than standard browser SSL security provided by, e.g. Internet Explorer. SAGEPAY encryption is also much more secure than that specified for the SET (Secure Electronic Transaction) protocol.

If we are unable to fulfill your order we will ensure you receive a full refund. Backordered items are not charged until they are posted.

terms & conditions for in-house course bookings

  1. examinations policy
    1. pearcemayfield will make every reasonable effort to prepare candidates for the examinations by means of its courses. However, pearcemayfield reserves the right to exclude a candidate from any pearcemayfield invigilated examination, should pearcemayfield or its representatives leading the course or invigilating the examinations judge that the candidate is insufficiently prepared for the examinations. Unless pearcemayfield incurs registration costs from the examining body, pearcemayfield will not charge clients those examination fees for papers from which it has withdrawn a candidate.
    2. pearcemayfield will make every reasonable effort to offer previous excluded candidates further opportunities to prepare for and take the examinations.
  2. in-house booking cancellation
    1. “Cancellation” is postponing or the outright cancellation by a Client of a confirmed reservation (“booking”) for a pearcemayfield consultant or training consultant.
    2. Once a client has confirmed a particular date with pearcemayfield, then if the client cancels or postpones that booking, pearcemayfield reserves the right to charge for the cancellation and for loss of fees. The following cancellation charges will apply:
      • More than 30 working days prior to the course – no charge
      29 to 20 working days prior to the course – 50% cancellation charge
      19 to 10 working days prior to the course – 75% cancellation charge
      10 or less working days prior to the course – 100% cancellation charge
    3. Cancellation charges to clients will include our own fees plus the full amount of any third party cancellation charges such as for accommodation and travel where these have been incurred or are likely to be incurred by pearcemayfield.
    4. In the event that pearcemayfield are unable to deliver a course previously agreed and confirmed in writing, the course will be re-­‐ arranged to be delivered on an agreed new date(s) and a 50% discount of Delivery Fees will be given.
  3. payment terms
    1. Payment is required prior to the event, unless otherwise agreed beforehand, by either credit card or Purchase Order. Invoices must be paid within 14 days of invoice date.
    2. Please see Terms and Conditions – Interest on Late Payments below.
  4. amendments
    1. We reserve the right for reasons of illness of the trainer or other causes beyond our control to cancel the course whereupon the client will be offered the alternative of another mutually convenient date or the refund of the course fee in full but we will not be liable for any loss of expense of the client arising out of such a cancellation.

Terms & conditions applicable to use of promotional codes

  1. registration
    1. Provisional telephone bookings must be confirmed by fax or in writing. Course fees are per individual. Unless credit terms have been agreed with us in advance, we will only send your course confirmation, joining instructions and any materials on receipt of payment.
  2. payment terms
    1. Payment is required prior to the event by either credit card or, where agreed, by Purchase Order. Invoices must be paid within 14 days of invoice date.
    2. For booking requests less than 3 working days before a course, please call 01235 227 252 to enquire.
    3. Your cooperation in paying promptly is requested and your attention drawn to our credit terms which requirement within 14 days from the date of the invoice. Payment after this period is subject to interest at 8% over the base rate of the Bank of England on a daily basis for the period between the due date and the date that payment is received.
  3. cancellation
    1. “Cancellation” is the postponing or the outright cancellation by a client of a reservation on a public Pearce Mayfield Associates Limited (‘pearcemayfield’) course
    2. If you need to cancel your booking you must let us know, in writing.  pearcemayfield reserves the right to charge for cancellation and for loss of fees.

The following charges apply:
• More than 30 working days prior to the course – no charge
29 to 20 working days prior to the course – 50% cancellation charge
19 to 10 working days prior to the course – 75% cancellation charge
10 or less working days prior to the course – 100% cancellation charge

  2. transfers
    1. If you wish to transfer to another event your request must be received in writing at least 14 days before the event
    2. Transfers will only be accepted if the booking has been paid for, however, if you haven’t you will need to settle the invoice before we make the transfer. (Transfers must be within twelve months of the original event booked). We make no administrative charge for this service and we allow you up to two transfers if necessary.
  3. amendments
    1. We reserve the right for reasons of illness of the trainer or other cause beyond our control to cancel the course whereupon the client will be offered the alternative of another mutually convenient date or the refund of the course fee in full but we will not be liable for any loss or expense of the client arising out of such a cancellation. In addition, we reserve the right to change the venue, course content, and/or trainer without prior notice.
  4. examinations policy
    1. pearcemayfield will make every reasonable effort to prepare candidates for the examinations by means of its courses. However, pearcemayfield reserves the right to exclude a candidate from any pearcemayfield invigilated examination, should pearcemayfield or its representatives leading the course or invigilating the examinations judge that the candidate is insufficiently prepared for the examinations.   5. special conditions
    1. No liability will be accepted by our Company for any loss or damage to personal property while attending public courses.

terms and conditions for the supply of products from pearcemayfield

the contract between us
  1. Any contract for purchases made through the website will be with pearcemayfield Limited, whose registered office is situated at Boston House, Grove Technology Park, Wantage, Oxfordshire, OX12 9FF, company registration number 4144238 (Pearce Mayfield Associates Limited).
  2. Pearcemayfield must receive payment of the whole of the price for the goods that you order before your order can be accepted and the contract formed. Payment is not taken until the point of despatch of the goods to you from our offices. Once payment has been received, pearcemayfield will confirm that your order has been received by sending an email to you at the email address you provide in your order form. The shipment email will include your name, the order number and the total price. Pearcemayfield acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
  3. Pearcemayfield are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.
withdrawal by you from the contract

If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here. This right to withdraw does not apply to business buyers.

  1. You may withdraw your order for goods at any time up to the end of the twenty first working day after you have received the goods. You do not need to give pearcemayfield any reason for withdrawing your order nor will you have to pay any penalty.
  2. The only circumstance in which you cannot withdraw your order is where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.
  3. To withdraw your order you must notify pearcemayfield in writing.
  4. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to the pearcemayfield return address at your own cost and risk, unless the goods were supplied faulty or damaged. If you withdraw your order but pearcemayfield has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to pearcemayfield at the pearcemayfield return address at your own cost and risk as soon as possible.
  5. Once you have notified pearcemayfield that you are withdrawing your order, any sum debited to pearcemayfield from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.
availability of goods you order

If pearcemayfield has insufficient stock to deliver the goods ordered by you, we will contact you to arrange a suitable delivery date. If this is not appropriate, any sum debited by pearcemayfield from your credit card will be re-credited to your account and pearcemayfield will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. pearcemayfield will not be obliged to offer any additional compensation for disappointment suffered.   Please note: we endeavour to bring our customers the best value we can by running special offers but please remember stocks are limited at the special offer price and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of amending the website when goods have sold out at promotional price can take a few hours to update. Please note that the price the goods are offered for tender are as displayed in the Shopping Basket. Rest assured your credit card will only be debited as your order or individual items from your order are dispatched.

multi-buy offers

Prices exclude postage and packing. Promotions apply to listed titles only, which are subject to change and availability. If you choose to purchase a product from a multi-buy offer, but do not purchase enough products to qualify for the special discount, the product will be charged at the normal price. Please note that on 3 for 2 promotions (and other multi-buy offers), the lowest priced title will always be the ‘free’ item.

delivery of goods to you
  1. pearcemayfield will post, or arrange a courier on your behalf, for the goods ordered by you to the person and address you give pearcemayfield at the time you place your order. For goods delivered outside of the EU, the consignee (ie the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required.
  2. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of despatch of the order. All delivery times quoted on the website are estimates only, based on availability, normal processing and delivery companies.
  3. You will become the owner of the goods you have ordered when the goods are despatched to you from our offices.
customs charges

If you are ordering goods for delivery outside of the EU, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that pearcemayfield has no control over additional charges in relation to customs clearance. pearcemayfield recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.

liability

This is as follows:

  1. If the goods pearcemayfield delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, pearcemayfield shall have no liability to you unless you notify pearcemayfield of the problem, in writing using info@pearcemayfield.com within 10 working days of the delivery of goods in question.
  2. If you do not receive goods ordered by you within 30 days of the date on which they were despatched to you, pearcemayfield shall have no liability to you unless you notify pearcemayfield in writing using info@pearcemayfield.com within 40 days of the date on which the goods were despatched to you.
  3. If you notify a problem to pearcemayfield under this condition, pearcemayfield’s only obligation will be, at its option, to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.
  4. pearcemayfield will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to pearcemayfield under this condition and pearcemayfield shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
  5. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit pearcemayfield liability to you for any death or personal injury resulting from its negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

force majeure

pearcemayfield shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

invalidity

If any part of these conditions is unenforceable (including any provision in which pearcemayfield excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

pearcemayfield operate a complaints handling procedure which is used to try to resolve disputes when they first arise. The daily interest charged for each day the payment is late is calculated from the ‘statutory interest’ – this is 8% – plus the Bank of England base rate for business to business transactions, divided by 365.

governing law
